'Missing' Brighton play area brings threat of court action

A Brighton property developer faces the threat of court action for failing to build the children’s play area that it promised.

Brighton and Hove City Council has served an enforcement notice on the developer McAleer and Rushe Group over the Brighton Station site.

Landowners Albion Inns and Cookstown Developments have also been served with a notice.

The building of play area was one of the conditions accepted by all three companies when they were given planning permission for their site three years ago.

Councillor Lynda Hyde, chairman of Brighton and Hove’s planning committee, said that since the Jury’s Inn development, the area in question had become an eyesore.

She added: “It has been made worse by the developer’s and the owners’ reluctance to install a children’s play area as the planning permission requires.

“This is despite the best efforts of council officers.

“Following several reassurances that the children’s play area would be constructed the council has been left with no alternative but to issue a planning enforcement notice.

“Residents there are entitled to this facility and are looking forward to their children being able to use the play area.

“This action will also greatly improve the appearance of a prominent location next to the station.”

The play area was part of the original development brief for the Brighton Station site aimed in particular at children living in the New England Quarter.
