Driver forged insurance docs in bid to dodge speeding ticket

A Brighton woman who made up a fictional driver to take the rap over a speeding ticket has avoided prison.

Carly Naine, 38, forged insurance documents in the name of Anna Baines, who she said had been behind the wheel of her mum’s car when it was recorded doing 100mph on a 70mph road.

But the documents didn’t fool police, who were soon arrested Naine for perverting the course of justice.

Naine, a single mother, appeared at Hove Crown Court on Friday, where she was also sentenced for a vicious attack on three police officers who were called to her home in Birdham Road, Brighton, after a disturbance in October last year.

Prosecuting, Kris Beverly said: “She named a Miss Bains as the driver and provided forged insurance certificate. But the address was a fiction.

“Naine’s mother was interviewed and confirmed Carly Naine was the driver. Officers interviewed her over the phone and she was hostile and aggressive but admitted being the driver.”

Defending, Richard Elliott said: “The forgery was extremely unsophisticated and was always destined to fail.

“She was banned from driving for six months for the speeding matter.

“At the time, she was fleeing domestic violence and moving from London.”

The court also heard a victim impact statement from PC Emmanuel Fatona, one of the three officers she assaulted. The others were PC Matthew Seekings and PC William Starr.

She spat in PC Fatona’s face and called him a “gay black c***”. At the same time she kicked one of the other officers in the head and tried to bite the third.

He said: “I was horrified by Naine’s behaviour. She showed no guilty, remorse or even concern and I was disgusted when she encouraged others to abuse officers.

“She made multiple threats to kill people saying she would stab anyone who came in. I was hurt by the comments made about my race and sexuality.”

Sentencing, Recorder James Hay said: “I feel it would not be appropriate, bearing in mind all the responsibilities you have and your own difficulties, to send you to custody today.

“The forgery was an idea from your ex partner, from whom you were fleeing at the time of the driving offence.

“The prosecution you were hoping to avoid was the speeding offence for which you have now been charged and have been disqualified from driving for.

“You have displayed remorse. I bear in mind your background and numerous issue and that you are the sole primary carer for your children.”

He gave her two 18-month community orders for each offence, with a requirement to carry out 30 rehabilitation activity requirement days.

He added: “I know in the past you have had issues with people in positions of authority and power. There’s a realistic chance of rehabilitation in your case.

“Your behaviour on the day you attacked those officers was absolutely appalling. I hope it will not be repeated.”

He also ordered her to pay £80 court costs.
