‘Inappropriate’ bin fence removal leaves rubbish eyesore

A pavement outside an exclusive members club has been littered with bins for months because the council said a fence hiding them was not in keeping with the area.

When plans were drawn up for Soho House, a bin store was not included – and when the club installed a fence to contain them on Marine Parade early last year, the planning department was not impressed. It was taken down a few months later.

Now, with no fence, the bins are spilling out onto the pavement again, where they blow over in high winds and create an eyesore.

Soho House says it’s now talking with Brighton and Hove City Council about an alternative fence.

Diane Messias, from the Kemptown Residents Association, said: “It’s been a mess for years. There was no provision on the original plans for a service (bin) area, which, for a commercial business such as this, was a major oversight.

After I complained numerous times, Soho House installed L-shaped fencing to mask the bins, which also stopped the bins from rolling into the road in high winds.

“It disappeared after a few weeks because the council said ‘there were complaints’ it wasn’t in keeping with Regency architecture and that it didn’t have planning permission.

“Soho House then employed a guy to keep the area in order. It was a vast improvement, but he went months ago.

“The bins – which were not planned for in the first place – are apparently considered a more salubrious sight than a tasteful fence without planning permission.”

A spokeswoman for Soho House said: “Since we opened four years ago, cooperating with the local community has been important to us.

“Unfortunately, our initial proposed fencing solution to conceal the bin store couldn’t be implemented due to heritage design requirements. We’re in discussion with the council about an alternative design.”

A spokesman for Brighton and Hove City Council said: “The fencing at Soho House was found to be in breach of planning control. While we acknowledge the fencing provided screening for the bins, the fencing, though suitable in some residential settings, was considered inappropriate for this prominent and sensitive location.

“We therefore asked for the fencing to be removed, but we have advised that a more appropriate and contextually sympathetic solution can be explored

“Soho House is able to explore an alternative solution through our pre-application process and we will, of course, consider any application if and when received.”

    I am concerned that spending so much time taking long-lens photographs of bins will deteact from Diane’s much more important campaign against the disgusting breeze blocks on Marine Parade.

    To clarify, Kemptown Residents Association is nothing other than a Facebook page, largely set up and populated by Diane Messias and a comrade in arms called Lev, who hides his identity. It is not anything resembling a constituted association.
    Diane is entitled to her views and I am sympathetic on this issue, however, she does not represent others views or Kemptown residents.

          Hashtags, yikes…we’re really scraping the bottom of the barrel. If you’re having to tell people you are a self-titled satirist…well, I’ll let you ponder on that one.

          Evidentially, Diane is more interested in ranting online then actually being a recognised residents association, or advocate or representing anyone, otherwise, she’d be…an actual residents association. The only time anyone ever sees her is when Pride is coming and she wants to complain that the the tourist town has tourists in it, and threatening to sue council officers, the council, other people who dare tell her she is being ridiculous, etc.

          You wanna be just a Facebook page? Get rid of the Residents Association name. I dare you. Prove me wrong.

            You clearly didn’t understand law back then when you were yelling about people being denied right of access (they weren’t) and you took offense when you were told this, rather more politely than I would have put it, by council officers, who tried to get a word in sidewards. Several years haven’t made much of a difference since then, it appears.

            You want to talk libel, shall we talk about Lev? The page admin of the Kemptown Not-A-Residents Association, that is constantly claiming brown envelope deals, devoid of proof or logic, and is never able to back anything he says up, even after several years conspiracy.

            Then again, if you decide to go back into a “self-imposed retirement as a KRA activist” because Facebook limits how much you can post externally, one has to wonder if you’re really just in it to make any changes – if you’ve done anything constructive over the last decade – or are just wanting a place to rant.

            Each to their own, I guess. Anyway, go whine about me further on Facebook, it’ll make you feel better.

      Yes, it’s a Facebook page, like hundreds of thousands of other Facebook pages. Whoever said it was ‘a constituted association’? Perhaps familiarise yourself with a dictionary, Katy.

      Oh, and take a look at how many people in the er, ‘association’ (oh dear, never mind) agree that something has to be done about Soho House’s service area. I represent those people.

    When you sue someone for untrue stuff they write or say about you, the Act you sue them under is the Law of Defamation; it covers both libel and slander. It’s Media Law 101.

    In other, er, ‘inaccuracies’, Manchester Pride lost a legal battle regarding street closures, which ruled on the legality of enforcing perimeter restrictions on public roads leading to residential properties.

    The outcome was Pride organisers and Manchester City Council could not legally enforce exclusive closures or ticket-only access on streets that serve as public rights of way to homes.

    This, naturally, gave Brighton Council and Brighton Pride pause for thought, because of legal precedent. (Doh).

    In another post, you wrote “There’s quite a few who just wanted to watch you get verbally outclassed by Lloyd Russell-Moyle on a semi-permeant [sic] basis for your childish rants.”

    Would this be the same Lloyd Russell-Moyle who was sent a Cease & Desist letter by one KRA member to make the harassment of him stop, or was it that LRM was just ‘over-enthusiastically demonstrating his verbal prowess’?

    As for “childish rants”, as the evening has progressed, ‘Benjamin’, your ‘comments’ are getting more and more ‘ranty’. Probably time to have a large glass of water and a Paracetamol and go to bed.

      Excellent. So we’ve established, by her own admission, Diane did actually do what she just claimed moments ago was libellous. Pretty dishonest of her, isn’t it?

      So, very open to lying to attack people. Wonder what that says about a person’s intentions? Doesn’t sound like the actions of someone who claims to represent residents, does it?

        I don’t live in Manchester. Nobody threatened to sue anyone – a judicial review is when courts examine the lawfulness of decisions or actions made by public bodies.

        Apart from that…

        Do better.
