Builder facing arrest over banned company name

Brighton Magistrates' Court

An arrest warrant has been issued for a builder accused of setting up a company with a banned name.

Shaun Peckham, 57, failed to turn up to Brighton Magistrates Court today to answer the charge of being the director of a company known by the prohibited name of BGC Sussex Ltd, without the leave of the court.

Companies House records show Peckham set up that company in early 2023, and a vote to dissolve it was taken in July last year.

Peckham was previously the sole director and owner of another company called Brighton Groundworks and Construction Ltd which went bust owing more than £100,000 to the taxpayer.

At court today, Insolvency Service prosecutor Warner asked magistrates to grant an arrest warrant not backed for bail – which means Peckham would be held in custody until he could appear at court.

She said there had been issues serving the court summons on him, but that it had finally been successful on 26 March when an officer knocked on the door of a house in Osmond Road, Hove.

She said: “They talked with a female occupant who provided her name as Mrs Hazel. She advised the service that the subject is the boyfriend of her daughter and that he was receiving mail there on a regular basis.

“This case has been adjourned a number of time to effect service. We are seeking a warrant not backed for bail today.”

The bench agreed.

The maximum penalty for the offence is six months in prison or an unlimited fine.
